Glowshot Terms of Service

Welcome, and thank you for your interest in Delightful Labs, LLC(“Delightful Labs,” “Glowshot,” “we,” or “us”) and our website at www.glowshot.ai, along with our related websites, hosted applications, mobile or other downloadable applications, and other services provided by us (collectively, the “Service”). These Terms of Service are a legally binding contract between you and Delightful Labs regarding your use of the Service.

BY CLICKING “I ACCEPT,” OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING OUR PRIVACY POLICY. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THESE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE.

1. Service Overview

Glowshot is a service that uses artificial intelligence ("AI") to generate professional headshot images of users based on photos that they upload. Users upload photographs, which our AI system processes to generate headshots with various styles, backgrounds, and poses. The Service may evolve and features may change at any time.

2. Eligibility

  • You must be at least 18 years old to use the Service.
  • You may not have been previously suspended or removed from the Service.
  • Your use must comply with all applicable laws and regulations.
  • If you use the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

3. Accounts and Registration

You may need an account to use certain features. Accounts can be created directly or through third-party logins (e.g., Google, Facebook). You are responsible for maintaining the confidentiality of your credentials. We are not responsible for any issues arising from third-party account providers.

4. Payments

4.1 General Payment Terms

Certain features of the Service require fees. All fees are stated in U.S. Dollars unless otherwise noted. Fees are non-refundable except as required by law. Prices may change with notice.

4.2 One-Time Purchases

By purchasing a one-time service, you authorize Delightful Labs to charge the disclosed amount to your payment method.

4.3 Subscription Services (If Offered)

If subscription plans are offered, they will automatically renew unless canceled before the renewal date. Your account will be charged for each renewal period unless canceled. You may cancel by contacting [email protected].

4.4 Delinquent Accounts

If payment fails, we may suspend or terminate your access. Additional fees may apply for chargebacks or collection.

5. Licenses

You are granted a limited, personal, revocable license to use the Service. You own the AI headshots generated from your uploads. By using the Service, you grant us a license to use your uploads and generated headshots to operate and improve the Service, comply with law, and display them in galleries or promotional materials. We will not use your uploads or headshots to train AI models without your explicit written consent.

6. User Content

You retain ownership of your uploaded content but grant us broad rights to host, display, and distribute it for the purposes described in these Terms. You are solely responsible for your content and represent that it does not infringe others’ rights. We may remove content at our discretion.

7. Prohibited Conduct

By using the Service, you agree not to:

  • Use the Service for illegal activity.
  • Harass, abuse, impersonate, or defraud others.
  • Upload harmful, infringing, or unauthorized content.
  • Distribute malware or disrupt the Service.
  • Reverse engineer or attempt to extract source code.
  • Resell or transfer rights granted under these Terms.

8. Termination

We may suspend or terminate your account at any time, with or without cause. You may terminate your account by contacting support. Upon termination, you lose access to the Service and your content.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. AI outputs may be inaccurate or offensive. You use the Service at your own risk. Our liability is limited to the greater of $100 or the amount you paid in the 12 months prior to a claim.

10. Dispute Resolution

U.S. users agree to resolve disputes by binding arbitration on an individual basis. Class actions are not permitted. You may opt out within 30 days by sending written notice to Delightful Labs.

11. International Use

The Service is operated from the United States. We do not guarantee availability elsewhere. If you are in the UK/EU, mandatory consumer rights under local law are not waived by these Terms.
